Buying a brand new phone from a person.?

Hello!

I'm buying a brand new in box phone (samsung galaxy s vibrant) from a person. I asked him for the receipt but he said he doesn't have one as he got it as an upgrade. I asked if i can pay by cheque but again he refused. How can i confirm that its not a stolen phone??
