Can some one tell me what kind of or the name of this is its on a tree or bush they are orange colored berries?

it looks almost like a holly ,its not bittersweet. Thank you

    Winter berry has red berries and looses its leaves, right now they are turning color actually.

    Fire thorn has orange berries and waxier leaves

    The person who told you fire thorn is correct if your berries are orange!

    If it has thorns, it's Pyracantha, or Firethorn. It may also be a winterberry of some sort - though they are usually red.
