how do I evict a tenant whom I share a commercial building? the landord has me under the lease.?

I am renting a commercial building and have a friend who I shared the unit with and helped with the rent. he has not paid in months and does not want to leave. The lease is under my name with the landlord of a commercial building. This friend has a business of his own and does not want to leave. How can I make him move out?

If he does not have a contract to be there, and he is in space that is yours under the contract, call the police and tell them that you don't want him there. Technically he is trespassing. Check your lease, you may be in violation for subletting.

In most states, when you as a property owner move to evict a tenant, you must follow a legally mandated process. California, for instance, requires that evictions must proceed through the court system, if a tenant presses the issue. Even in cities such as San Francisco, with a strong rent ordinance that includes a "just cause" eviction provision, you can evict problem tenants if you adhere to proper protocol.
