"Legally blind" people (U.S.)?

Are people who are "legally blind" (in the U.S.) required to carry a white cane? What if they have a guide person, a service animal, or are in their own home? Are legally sighted people allowed to carry a cane of any color *except* white? What about colorblind people?

    Legally blind people are not required by law to carry a white cane, work with a guide dog, or use a sighted guide. However, if a legally blind person *does* have a white cane or guide dog and a car hits them, the driver of the car is legally liable no matter what. If the blind person is not using white cane or guide dog, the driver is only liable as far as they would be otherwise (say a blind person walks without white cane or guide dog right in front of a car...the driver is not liable, but would be if the person had white cane or guide dog).

    Sighted people can carry canes, though in many states there is a law against people who are not blind carrying a long white cane. Note *long* white cane. A sighted person can have a white support cane if they so desire, but in many states they cannot carry a long white cane.

    Colour blind people do not fall under the category of legally blind, so cannnot carry a long white cane in many states, and have the same rights and restrictions as sighted people do.

    Source(s): I have been legallly blind since 2008. My source is the White Cane Law in North Carolina, which makes it illegal for sighted pedestrians to carry a long white cane. Other states also have this provision in their white cane law.

    Legally blind people are not required to do anything differently than a sighted person. To require them to do anything would might lead to legal requirements for others with handicaps...like ignorant people being required to wear a dunce cap.

    Sighted people are not permitted to carry the long white cane w/ red tip reserved for blind people. These canes warn motorists and their misuse is like using a handicap parking placard when one isn't handicapped.

    Colorblind people fall under the same category as hearing impaired when it comes to canes, service animals, etc.
