Ebay item arrived damaged (USPS Insurance claim)?
I purchased a limited edition snow globe for $100 with $25 shipping and handling.
Seller used Economy Shipping and had the Ebay buyer protection and insurance on the package.
My item arrived broken. I noticed a tiny broken piece and when i took it out 2 other parts were broken. The snow globe was bubble wrapped, had a box, then packing paper and popcorn foam. I contacted the seller right away and I was told i could get half back or file an insurance claim to get refunded. As I'm reading about the USPS insurance I noticed the seller has to file the claim and that the item will be taken by USPS. I don't want to lose my item as well as half my money.
What is the best thing to do?
Please provide as many details as possible or suggestions or the procedure. First time going through this bad experience with an ebay transaction.

Report that it is not as described and eBay will cause a full refund. You should provide the seller with evidence of the damage but, as others say, it is their responsibility to ship in one piece and their responsibility to claim of their shipper if that doesn't happen.

I think I understand.
The seller is giving you two options:
1. Accept a partial refund from the seller, and you'll get the keep the item in its current condition.
2. File a damage claim with USPS, in which case they will likely confiscate the item but you'll get all your money back.
If you are really unhappy with the item and don't want it, YOU can actually go ahead and file a damage claim with USPS, as long as you have the tracking #, which will indicate that the buyer purchased insurance. You can file the entire claim on-line...it's actually pretty easy. With USPS, either the buyer or the seller can file. It's usually more straightforward if the seller does it, though, and you can get your money faster.
If you file a claim, be sure to keep ALL of the original packing material and original box it came in. USPS may want to verify that the item was packed safely enough. It's possible that they can determine the packing job was so bad that it never would have arrived safely in the first place, and they can deny the claim. If they determine it was a sufficient packing job, then they will find in your favor and refund you both the insured amount and the original postage.
If you are OK with keeping the item, you can just tell the seller you'll accept a partial refund.

Shame on those of you that keep posting answers that screw the seller. Based on what this buyer has posted the seller had adequately packaged the item and isn't at fault for the post offices carelessness with the package. The party that should be shelling out the cash is the post office. File a claim and get them to pay for the item, accept the partial refund and keep the item or return the item and get a full refund. You can't expect a full refund if you intend to keep the item. I'm an eBay seller myself and would hope my buyers would be fair in situations like this. I'm also an eBay buyer and would never intentionally try to screw over a seller like this. Especially when there are multiple ways of getting the money back without doing so! Again shame on some of you! The seller is trying to work with the buyer and easily could have just told her to file the claim with USPS and made no such offer to refund anything. Ever heard of not having your cake and eating it too? BTW, in situations like this eBay goes back and reveiws communications between the buyer and seller. Just saying.

I was told at my local PO the either the buyer or seller can file the claim, but they don't want the item traveling back and forth. Once the buyer has the damaged item they can keep it or have the $ but not both and they don't want it necessarily going back to the seller because how could they prove where the damage happened? The point of damage becomes muddled voiding the claim.

Seller is telling you wrong information. You get the whole price back either through him, through Ebay Buyer Protection or the post office. If you file a dispute with Ebay for the damaged item you have to ship item back to seller to get the refund but another way is to get the insurance receipt from the seller and take it to the post office yourself, so they can see the damage and file a claim yourself. That would save the trouble of shipping back to seller. It is easier for you to file insurance claim than seller because seller might have to have the item or at least photo of the damage.
Of course, you must bring the original box it was shipped in to the post office and they may decide it was not their fault. Then you should file an Ebay dispute for damaged item within 45 days of auction date.

In order to file an insurance claim,you will need to hold onto the box it was shipped in and the item,present them to the post office the way you received the item. I would file an insurance claim and file a claim with paypal and also ebay. Paypal first.

For UPS, the shipper (seller) files the claim.
But for USPS, either the sender (seller) or receiver (buyer) can file the claim.

I'm a diehard ebay user, and what I always do is go through paypal. If the seller doesn't quickly help you, file a claim through Paypal and it will be processed quickly. The seller will have to respond to the claim and if they don't, you are automatically refunded. It works hand in hand with ebay's buyer protection program.

fu ck that sh it! post office is going to pay me and im keeping the item. they broke it not me. i bought the item on ebay its my item! they broke it and i want the funding to fix it as it is collectable and rare so cant be replaced easily. there are laws that do protect you in these situations as a person buying an item once you pay for it... it is your legal item! if they refuse i will file criminal damage to property as they deliver to me constantly and retaliated as an angry employee. you state this case they will give you what you want before even second guessing anything. **** nazi america!
