Marry my girlfriend from Guatemala?
Can I marry my girlfriend from Guatemala or would that be a problem? We plan to get married in 4yrs. I don't know anything about her personal status right now. She has been here for 7yrs and she can travl on planes. Would we have any problems getting married? I'm a legal U.S. citizen.

Hi Addison,
so you wanna marry your Guatemalan girlfriend in 4 years from now and you don't know anything about her personal status, right? Don't you wanna find out first?
Anyway, if she is legally in the U.S. then that would be no problem whatsoever. If she does not have a legal status however, she would have to go back to Guatemala first and apply for residency in the U.S. through the U.S. Embassy in Guatemala City. There's a fiance visa available and it should take no more than a couple of months to get it.

since she is in the U.S. illegally, she will not qualify for a fiance or spousal visa. she is subject to deportation at any time. She would need to return to Guatemala and stay there for at least several years. you could consult an immigration attorney and see if he can help you find a way, but since she has been here illegally, I doubt it. Marriage will not give her the right to remain in the U.S.
