Can I sue my college financial aid for lack of progress?
I have done FAFSA and it was submitted last Feb 27, 2011. The information was set up by the federal system. I have already receive pell grant and tag. Later in August the financial aid department asked me for federal tax income and I fax it to them by the bank. Couple days later they called up again for that information and I told them that I already send it to them. They told me that they never got it. I back to the bank and fax it to them then I came home and called up to see if they got it. They said that they never got it. My classes was already started. I had to wait next day because the bank was closed. Next day I fax it to them and then I found out that the college's network shut down due to Hurricane. I waited after few weeks and their power came back on and I called the financial aid and they still tell me that they never got it. I went to the bank and had it fax for the last time and called the financial aid and they finally got it. One of my classes was only online and I couldn't get the access. I called up the college about it and they think it was the financial aid and I called up financial aid and they said that they didn't put it on hold. So it all work out with online department but I lost two classes which I was forced to withdraw. The chairman of the department put me back on one class and I still lost other class. So I have three classes and it effect my funding receive. Couple weeks into September the second week they told me that they need the second page of the tax income that was not through the fax. I wasn't happy to hear that and I decided to scan it to their email. They of course claim that they never got it. I told them that I want to speak with a person who run my finance and they transfer me to her and I start to complain about her staff lack in responsibly. She told me to scan it to her without apologetic and I scan it to her and she said that she got it. Later into October she finally let me know that I owed them money. My financial aid funds won't cover most of the classes because it was under 12 credits. She gave me the summary charge and I bring it to my DVR for help and my DVR was confused with the summary charge because it like they charge me double. So she contact with my financial aid advisor and of course my advisor didn't response the call. My DVR said that she won't pay the first quarter because it was already ending soon and that she will pay for the second quarter. I wasn't thrilled with that. I went back to financial aid department to check with advisor and she told me that she did got the call from the DVR and she just realize that she charged me twice of the two classes that I dropped and add one. She fix it and she told me that she will tell my DVR. So later I got the letter that I owed the college 2,735 dollars. I have no money and I bought the textbooks with little money that I barely afford. I called up complaining to my adviser that I am not paying for all the mistakes she made and the lack progress that effect my funding. She send me to academic adviser and I told him and he told me that he can't do anything about the money since he is only help students with classes. Then he send me to the chairman and I told her the situation and she told me that she is only a teacher and a chairman and she have no power over the finance then she send me to the director of financial aid. I complain to the director and to see why it wasn't cover and she told me that my DVR refused to pay first quarter and that she pay half of the second quarter as I recalled that my DVR told me that she will pay for the second quarter. I asked her for waived since it their fault of my lack of receiving funding. She said that she can't waived the tuition just because the classes was either already ending or starting. I asked each of them to give me the president of the college's email and phone number, they all had avoid my question. The director of course send me back to the financial aid adviser that she can help me which she couldn't and she was the person who send me to another person that got nothing to do with my financial aid. I wonder if I can sue the college or financial aid for particular reason stated here. If I can and what should I be looking into or do?

1.I know your at a school for proffit, devry,westwood,phoenix,UCI etc-BAD IDEA
2.Finacial Aid is not an entitlement because the money doesn't come from payroll tax but rather income tax
3.Your Financial aid office&your school jipped you<NOT FINANCIAL AID
4.Yes you can sue, they actually get sued and loose ALL the time for their barbaric strong armed practices, I would also file a complaint with the FCC and your city attorney general

basically when its comes to financial aid stuff you don't FAX or send EMAILS you physically go to the college and provide them with the documents that's you big mistake you made. If you just went to the college and done this in person this big mistake would never had accrued. Now you may end up paying thousands of dollars because you didn't bother go to the college IN PERSON. If you think about sueing contact an attorney or forward this information to the LAW and ETHICS section under Politics and Government.

Just because you completed FAFSA does not mean you completed the process at your school for Fin Aid
You might find out that there was a Fin Aid paperwork deadline (typically about 4 months before the semester/quarter starts)... with this, you would have had to get your tax records to them prior to that deadline (you refer to getting this to them in August)... even if the first fax had been verified as received..... it wasn't done early enough
DVR --I can only assume Department of Voc Rehab--- in most states, they can not approve money for a semester/quarter if it has already started... and it can take a year to get from point of approval to get help & then get to the point of being funded for that help
It sounds to me like you missed some steps and/or did not plan properly
You should not have started school until you received your actual award letter from the school itself (not just FAFSA)
because of this, it could prove difficult for you to win a case
Feel free to try.... but you better find out first if you are about to throw money at attempting a law suit that will end up with you not getting anything

Just explain the extenuating circumstances that led to your academic difficulties, and assure them that you're taking steps to make sure you won't slip again. (Is there some sort of contract/probationary agreement you can make with them to show them that you're being proactive about this?) Assure them that you plan to make up the work you didn't complete and that you are on track to succeed. If you're going to tutoring (or have other academic support), tell them that. Show them you're serious. And have someone proof-read your letter before you send it! It needs to be clear, professional, and grammatically correct.

Maybe you should of took your tax info to the school and not just keep trying to fax it over. People start to act crazy when you ask if they receive something. So, physically hand it to them!

Well there has to be a way where you have proof that they got your taxes....why dont you send through ups and required like a signature?
