What is the legal definition of hacking?

In US or international legislation, what constitutes illegal hacking? Where can I find the precise definition of hacking?

    You probably won't find one- in most cases it falls under other laws that range from "invasion of privacy" to "Theft of intellectual property" to "espionage".

    It's hard to define hacking itself really-to some people it's exploiting computer code to find a weakness and gain entry to a network or server through a "back door"..it can also be stealing (or guessing passwords).One scam that's used to get into corporate/gov't networks is to call a person who works there ,pretend you work in the IT department and trick them into giving you their password.(this is called "social engineering")-you don't have to know much about computers-or networks to do that-you just have to know how to trick people,but the fact is even though that doesnt require much in the way of real computer skill,it's still considered hacking.

    In Canada where I live you won't find the word "hacking" in the criminal code or other communication law.Basically -if you were caught doing it other laws could apply -in other words the seriousness would be judged by the damage the perpetrator caused;this can be damage to an individual or a company.

    Section 342 of the criminal code in Canada says this:

    Every one who, fraudulently and without colour of right, (colour of right basically means "proper permission")

    (a) obtains, directly or indirectly, any computer service,

    (b) by means of an electro-magnetic, acoustic, mechanical or other device, intercepts or causes to be intercepted, directly or indirectly, any function of a computer system,

    (c) uses or causes to be used, directly or indirectly, a computer system with intent to commit an offence under paragraph (a) or (b) or an offence under section 430 in relation to data or a computer system, or

    (d) uses, possesses, traffics in or permits another person to have access to a computer password that would enable a person to commit an offence under paragraph (a), (b) or (c)

    is guilty of:

    (e) an indictable offence and liable to imprisonment for a term not exceeding ten years, or

    (f) an offence punishable on summary conviction.

    So that law pretty much says entering a computer/ network where you have no business being is illegal-that can mean stealing the computer or even paying someone for their password.I don;t know about other countries but I'd expect wording of their laws is probably the much the same.

    The previous answer is incorrect. Hacking is very well defined under federal and state laws as "computer trespass. Essentially, the definition is using a computer without authorization.
