Nope! Because they would already be dead! it would probably just be written off as "desecrating a dead person"!
But if the vampire was a prominent member of society then... yes!

A. You would be defending yourself.
B. If you are talking about someone (example- a neighbor) who claims to be a vampire, but can see their own reflection, isn't nocturnal etc. then it would be murder because that person is just a misguided person, not a vampire.
C. If you are talking about TV/ movies, then it's all fictional anyway.

If he or she is not trying to hurt u they are humans too just a another variant human. Not all vamps r bad.
