In the Philippines, if you were drunk and punched a police officer in the face, what would happen?

My brother in law in the Philippines was drunk, and somehow punched a police officer in the face. Now I hear they want 1,200 Pesos to release him, if not they say he will serve 10 years in prison??? Is this normal? Is this just a bribe or actual law/judgement? What if he doesn't get the money, will they actually keep him very long, the whole"10 years" or what might happen?

    I hate to say this but, your brother in law is lucky enough to stay alive when he punch that police officer in the face, some people who do that had been found dead floating in the river or sea or seen laying on the road or street with no breath coming from their mouth.

    He must pay that 1,200 pesos as part of bail, such if he don't want to stay in jail, because if he do refuse, then his life may put in danger, you cannot predict what's on the thought of the police he just punch.

    Staying in jail for 10 years is just an exaggerated story make by them; it is part of psychological interact not to let your brother in law repeat what he did.

    Drunk or not, it was still assault on a police officer.

    Legally, the cop files a complaint, and your brother in law stays in jail awaiting trial (about 6 months- a couple of years) That is, unless you pay bail. During trial, he stays in jail. (a few months - years depending on the number of appeals, blah blah) If convicted, he may get a sentence of 4-10 years. All this time and lawyer's fees, will end up more than the 1200.

    Or, you could pay the cop the 1200, have him sign an Affidavit of Desistance, meaning that they will not pursue a case against him, and he walks scot free. This is in essence a bribe, to the victim, to not file a case, but hey, if the victim is the one who initiated it, it is all good, IMHO.

    No offense but did you ever think that your brother in-law just needs money and figures at that amount you would not complain too much or check with the police Department?

    Perhaps it never happened at all and it is just an easy way for him to get some money from you.....

    I would tell him you want to check with the police department and request he gives you all the information for you to reach the police department to check on the situation.

    See if the story changes or the price goes down then......

    you sure it is not in US dollar and just in 1,200 pesos. the punch might not have been serious though.

    better settle it before it reach the court or spend more .

    I've been in and out of courtroom for the past 10 years.

    Are you serious? ONLY 1200 P for assaulting the cop? For that money , line them up and I will be punchin on throughout the night. Bargain. Plus--anyone who cant scrape up a paltry P1200 to save 10 years in prison deserves the rap.

    Yes he can spend 10 years in jail. Heck it will take at least six just to get to court and that's a non bailable offence. In the meantime he sits in jail and rots. Philippine prision is no joke like the palaces we keep in the states by comparision.

    Listen to what "Lone Worf" says. This is one of many scams used here to get your money.

    Chances are that when & if he gets some money he will buy more booze. In Tenn. if you do something like hitting a cop - you go to jail so he should do the same.

    I think anywhere in this planet, you will be arrested if you are drunk in public and you punch a police officer...

    that 1,200 is already a bargain... you bro-in-law is lucky he is still alive and uninjured...

    1200 is a deal they must think that's all he will be able to come up with.

    Its legal. the officer can sign a disistance letter.

    the 1200 will go to cover medical costs.

    its not a bribe he is lucky its only 1200 peso i would pay it right now or he will go straight to jail he is honestly he is lucky they didnt shoot him
