Is grand theft determined by the current market value of items or original sale price?

If a person stole items, would the grand theft charges be based on the current market value of the stolen property or what the owner originally paid for it?

For example, a person steals a computer that was worth $2,000 back in 1995 but now it's only worth maybe $100 on the market.

    It depends on what info the burglary victim had on their computer and what additional software they installed on there. Yes the computer itself might be lower in value but the info inside is what could matter. The judge may take that into consideration. You better hope there wasn't anything important on the computer.

    I agree with all of the above, but I will add that when it comes to court, the defense attorney can try to argue value. That happens a lot in cases where someone has stolen scrap metal. The officers charge based on the reported value, then they argue over actual value, based on what the suspect received from the scrap yard. You can steal $1000 worth of stuff, and only get $50 for it.

    Replacement cost.

    A rare coin or stamp is valued at the replacement cost. The same goes for other objects.

    However, the owner can always claim that the original price remains the value of the item. No criminal has ever successfully plead down a charge because the item was old.

    Replacement cost, if the computer was no longer being manufactured they would go by the price of the nearest model today and that would be the value.
