Can I use the Right to Equal Education to back up my argument?
I came to America during my sophomore year. In my school district they have a special math and science advanced program. To enter it you have to take a test during 8th grade, and meet some other requirements. If you are not in the program freshman year, you are never allowed to enter it. I was not in America during 8th grade. However, I am overly qualified for the program. Is it possible that I use the Right to Equal Education to back up my argument of getting into the program during my senior year? The same exact classes I will be taking at my school are offered at that program, just with better equipment and a better learning environment.
I'm not planning on making a court case out of it, just a letter to the program's admissions office stating why I should be in that program.

You can SAY it, but you'd have to get a lawyer to really press the fact. Speak to you counselor and get his/her recommendation that you be entered into the program. It wouldn't hurt for you to get statements from your other teachers. You need to take care of it NOW.

Thats not a right. Saying it is doesn't make it so.
You can request to be admitted to the program, but you don't have any type of legal right to be admitted to the program.
