Help! How can we stop my friend's wife from taking his Social Security Money?

My friend's wife is going to take some of his Social Security Money...we already called Social Security and that's what they told us. How is she able to do this? Is it legal?

More thorough details might help get you more direct answers.

If they are still legally married she has every right to it.

Are they separated, have either filed for divorce?

    Is she his rep payee?

If they have been married over 10 yrs she qualifies when he retires under his social security, if his benefits are more than hers or if he was on SSDI & she is also disabled. If they have minor children they would get benefits under him as well.

He needs to go to his local Social Security Office to clarify any & all of his questions.

if you actually mean ss,then she can,but it does not take anything away from what he is entitled to anyway,so it makes no difference To him at all
