Florida: Is it illegal....?
To not pick up a dogs waste on "their" property? It is a 6 housing apartment place, no dog-waste rules like in big apartment communities. i live upstairs and the guy downstairs lets his dog go where ever and just leaves it. claiming its his property. So nothing i can do about it?

If the units are attached they constitute a legal condominium and there are no individual exterior real property rights. All external property is part of the common elements jointly owned bu all occupants. Regardless of the legal consequences a call to the landlord should resolve the issue if you have't already. Dog nuisance laws are county and city ordinances. Look up Dog fecal matter laws for the county or city of----- and read the ordinance. After you read the ordinance get a picture and call animal control to see if a citation is in order. I am including a copy of Broward County's ordinance
It is against the law for any person to allow a cat or dog to defecate (go to the bathroom) at any of the following places:
the sidewalk of any public street, park, beach or school ground or other designated area
any private property not belonging to the pet owner, unless the person makes an immediate effort to remove any feces/mess left by the pet
any swale or street right-of-way that deposits water to a canal, lake or other water way unless the person makes an immediate effort to remove any feces/mess left by the pet
Further, a pet owner cannot leave a pet in unsanitary conditions that may cause offensive odors as this is dangerous to the pet and to public health.
It is also against the law for a cat or dog to be allowed to habitually bark, howl, whine or damage the property of another person.

Most every one of Florida's 67 counties has a pet-waste ordinance, so if he refuses to pick up the dog waste simply call your local sheriff's non-emergency number (public service announcement: do not call 911 for such an incident; it is designed for emergencies only. Call the regular number and you will have your needs met without wasting county resources. It is in the blue pages in the phone book. Peace out!)

The breed matters because some dogs have to be trained differently due to certain natural instincts.

This is how I trained my dogs, hope it helps:
Throw the toy, give the command "fetch" or whatever you use and have the dog bring the toy back. Don't let her know you have the treat. (If she knows, just hold it behind your back.)
Grab the toy still in her mouth and say "thank you". She should release, if not hold the treat in front of her nose. When she lets go, quickly praise her and give her the treat. Pet her alot too. Do this over and over. Then after a week or two, give her a treat one time, but not the next, giving her praise both times. If she does not bring you the toy, ignore her. When she does bring it to you, do as above.
When she plays tug of war, do the same, tell her "thank you" and put a treat under her nose and when she lets go, praise her and give treat. Give the toy back, sometimes they don't want to bring you the toy because they think you wont give it back (hence the "throwing it" part of fetch).
If she runs away with it, let her go. To her it's a game, "watch me make them chase me" is what she's thinking. If you don't show interest in it when she runs, she'll stop, but this will take time too.
Enrolling in training classes can help too. Just be consistant.
I play tug of war with my two Great Danes and there is never a problem. When I want them to let go I say "thank you" and they drop it immediately. Sometimes they win, sometimes I win when I say thank you. Its all about training and dominance. They know I am Alpha in the house, there is no question about it and I am consistant with training.
