Probable cause seizure?

An agent took my iPhone while i was being investigated for arson, can he legally keep it for as long as he wants with just probably cause? Because i would really like my phone back. He took it on friday. By the way i live in south dakota.

    I suspect the "agent" has obtained a search warrant to view the contents of the iPhone.

    Your property can be held as evidence pending the outcome of any judicial action taken through the courts.

    You can, of course, call the agency responsible for seizing your iPhone and ask them if they are going to hold your iPhone.

    Yes. As long as there is an active investigation still going on the phone may sit in evidence. After retrieving all of the info from your Iphone you may ask if they are through with it and they may give it back to you.
