Is there any way I can kick my roommate out without giving her a thirty day notice?

Idk if this applies in every state, but in Nebraska you have to give someone thirty days notice before kicking them out. However, my roommate has been doing drugs inside my apartment and eats all my food. I have a five month old daughter BTW, and I really don't want her around drugs. She's not on the lease, so can I just kick her out now?

    She doesn't have to be on the lease. She is still a tenant and she is entitled to 30 day notice. (And you wouldn't be allowed to simply kick her out at the end of the 30 days. If she refused to move, you would have to file a court action (called an Unlawful Detainer) to evict her.

    If you want to try to push the process along faster, you can give her a 10 day Comply or Vacate notice in addition to the 30 day notice. (Always give the 30 day notice so your bases are covered.) Your 10 day notice can state she is violating your agreement by using illegal drugs within the apartment and consuming groceries she did not provide and that she is required to comply with the agreement (by not using drugs and providing her own groceries or move out within 10 days.

    If she violates the 10 day notice, you can file to evict her on day eleven.

    But again: You can ask a resident to leave. But you can't throw them out unless you have a court order.

    Yes you can, if she hasn't been there for more than a year (squatter and co-habitation etc.) then she is a house guest. Also the drug thing is your leverage, she can leave or you can call the police. Use that one as an ace in the hole, and only if you don't participate. There is no roommates rights, if the other party has over stayed their welcome and commiting illegal acts (that could get you breached on the covenants of your lease) you are justified to kick her out, so if you give her sometime that would just be classy.

    If she had a hire, the it in all risk is going to a month to month hire after that. If she paid for the month, you may't kick her out with much less time than the hire facilitates. If she has no longer paid hire, then you certainly delivers her a three day pay or quit word and she or he has 3 days to bypass out...yet your hire would have a minimum time of being previous due ahead of the pay or quit. Michigan does not have a minimum time requirement....Or a minimum of did no longer in 2002 once I bought my final apartment in Detroit.

    If you want her out quickly, suggest that she stop using or possessing drugs within your apartment, or you will call the police. That may be enough to send her packing. Otherwise, you will have to follow normal procedures to evict her, or face possible action yourself for illegal eviction.

    There're no legal ties to show that she is actually your roommate, so I'd say you can. I would maybe still give her at least a week to get her stuff straightened out.
