can you join the navy with one dui on your record?

This is the only blotch on my entire record.

    The answer today is probably "no." The answer tomorrow could be different. The reason for this is that the Navy changes its policy from time to time depending on the Navy's need for recruits. It also depends on how old the DUI conviction is and exactly what the DUI conviction is (for example: a "wet reckless" is less of a DUI conviction than a straight DUI conviction).

    The Navy classifies a DUI as a misdemeanor because most states consider a DUI as a misdemeanor (The Navy uses the classification of the state where you got the DUI).

    When you apply for the Navy you must tell the recruiting officer about the DUI conviction (not telling them could be state-law perjury or a new federal offense). If the recruiting officer denies you then you can appeal to the Commanding Officer of the recruiter. That is your only appeal.

    A criminal defense attorney can tell you what your chances are for entering the Navy with a DUI in your home state. The DUI criminal defense attorney can also help you draft the appeal. However, the DUI criminal defense attorney can not represent you at the appeal process. The reason for using a DUI criminal defense attorney is that the DUI criminal defense attorney will know what facts about your life and the DUI to include or exclude from your argument on appeal (DUI attorneys do this for a living).

    Finally, the Navy and Air Force are the most strict branches of the military when it comes to this kind of thing. The Army is a bit more lenient when it comes to joining while having a DUI on your record.
