The cops had probable cause when they broke in. They had evidence that he was the one who did the shooting. The guy was arrested and then questioned before he was released. Things like this happen a lot more than you think. He can sue if he wants but a judge would throw the case out because nothing illegal was done to him.

I don't think he should. When these things happen, the atmosphere is poisonous and everyone suddenly has a weight of tension on their shoulders, anxiety, especially the police. It's a reasonable mistake, and under stress people make accidents. No one's perfect. Of course, it'd be logical to sue them, but it wouldn't be right, and I'm sure he'd understand and reason.
