Am I responsible for her debt?
My Mother passed away recently and left me a little bit of money. Four months after her death the Dept of Work and Pensions say they overpaid her after her death, am I responsible for her debt.
It has been through probate and I was given a Certificate of Administration and no claim had been made then. Also it need not have gone to probate as it did not reach the threshold but a mistake was made and really I had only needed to sign a declaration.

when it goes thru the probate court, if their is a claim it may be paid out of the estate. Thats why probate takes 6-12 months so all bills can be satisfied.

The money isn't legally "yours" until her estate has been officially settled. You aren't technically responsible for her debts personally (her estate is), but you may have received a premature distribution and the executor/administrator of the estate can be held personally liable for getting the money back to pay the debt. That's one reason courts require executors to post a bond when they're appointed, as security for mistakes in handling the estate's money.

Hi,dear one.If you have accepted the probate of your only mother,s heir,and if she hasn,t left any granted will,her debts would be paid from all her remaining heritage first and more than that you are not responsible.I also confirm the first answer.please take it easy and don,t worry.so long.
