Ginkgo tree problems?

Okay so I live in a very nice area and my neighbor has a ginkgo tree, a female ginkgo tree that produces fruit every year. This tree sticks over onto my property. The landlord next door/neighbor has come to me once about it asking if I would like it pruned and I said yes but she never did anything about it. My parents live here and are getting too old to keep cleaning up after this ginkgo tree and its nasty *** berries. It is also bigger than our house and we are afraid one day it will come down into our living room.

ON TOP of this my neighbor moved out to her wonderfully huge house in LI and hasn't come back in a couple of years. We hate it, her tenants hate it, and the whole neighborhood hates it. We live right by a school and on a very busy block so the ginkgos are constantly getting squished and we have to power-wash them away. I don't want my parents to keep having to clean this crap up. Is there any way I could sue her or something to get the tree trimmed? I know I can do it myself but it's her tree and she is supposed to take care of it. I just don't want my parents to keep having to do it.

    Talking to the landlord should get some action.

    This is kind of a tough issue to address, as there's not much you can do about a tree on a neighbor's property. Unless there's a local ordinance or neighborhood rule otherwise, usually you can plant whatever kind of trees you want on your own property. Generally you can compel them to prune the branches that are over the property line, but that's about it.

    One thing you might want to try - Ginkgo fruit is highly prized by many Asians- and it's hard to find in this country. Try posting on craiglist or somehow getting the word out when the tree is fruiting and you might find groups of Chinese or other Asian-descent people picking the fruit up for you. It worked for a friend of mine in Brooklyn.

    Ginkos have stinky fruits, yes. Gingko's are very strong and resilient. Its not likely that it will EVER fall on that house while that house exists.

    If your land lord wants to keep her tree, and you hate it SO SO MUCH! Then move out. You nor your parents own the property. I suggest you try to calm down unless you want to find someplace else to live.

    Contact the owner- in writing- and ask for it to be pruned. If you state your fears of damage to your property from the tree (even if you have no real fear of damage) and remind her that she is liable, it will get her attention.

    Keep copies of all letters you send to her. If she doesn't do anything, you have recourse to your local Council. Either they'll do it or compel her to do it.
