The left side of my beats stop working in certain positions?

I really need help. My beats I just bought on Craigslist and the left side where the wire goes In only work in certain positions where the cord is loose. I am mostly sure they are real. I think the headphone jack is broken or something cause when I touch it the songs is staticky. I used the headphones in my computer iPhone and iPad so it's not the device. Please let me know if I can sent them back even without a receipt or how to fix them. Thank you .
