Do you pay an employee (personal care assistant) holidays even if she didn't come to work that day?

She says it's an union thing. But the PCA agency told me that they have to be in the work place in order to get paid. I think she wants to be a smart-*** and get more money without working. Oh, I live in Massachusetts.

Update:

I don't make money off of her or the agency. I just manage the payroll. And with just 15 hours a year for holidays, you have to control it. So stop talking like I'm making money off of her or anyone!

Update 2:

Besides, what kind of message does that send: work as little as possible and you'll get a whole lot.

You, personally, do not have an agreement with the union to fork over holiday pay. That's the responsibility of the PCA agency. Any personnel costs that you incur will be billed to you by the agency, so you don't have to be concerned about it. You're right...your pc assistant is being sly in the hopes of a little bonus that she didn't have to work for.

It's nice to give good employees paid holidays. I know some people do not realize it, but employees have families too. But then again, not every employer wants to be nice. Most want to make as much as possible, have others do as much for them as possible, and give as little as possible in return.

That is based on Union Contract. Suggest you read it.
