I am ordered to provide health coverage to my child, but I am changing jobs soon. What do I do?

Currently I make 700 a week and am ordered to pay 95 dollars a week in child support as well as cover my son under my medical plan. My current medical plan offered by my enployer costs 85 per week for me and my son. I live 35 miles from work. I work 48hrs a week. That's all fine and dandy, but I am changing jobs soon. My new job is only going to be paying 600 a week, but offer less hours and is only a mile from work which would allow me to spend more time with my son.

Child support obligation will change, but my main question is what do I do about my court ordered health coverage. I could persue cobra payments, but 165 a week for that is not affordable. I beleive Indiana law states I only have to provide coverage if it is affordable, at a maximum of 5% of my gross income. What should I do? The new job may offer coverage, but it won't be active until my 90 days. What if my new job does not offer coverage? Any insight would be beneficial.

I am receiving a lot of condescending answers. Thats not helpful and you should probably keep to yourself. I have and will continue to provide for my child. Obviously, the COBRA isn't an acceptable option. If i get paid 600 per week, minus taxes and child support and minus cobra, that would leave me with 150 per week. That doesn't even pay for my mortgage. That's completely unacceptable and you know it. I have not taken the job yet. No matter what jobs you take, there is going to be a 90 day waiting period for insurance eligibility. My child support obligations don't require me to keep the same job. I have to take a new job, as I cant afford the gas to get back and forth to work anymore. I work to many hours and those hours cut into the time that I have available with my son.

If Indiana says "his" part of the insurance payment is a maximum of 5% of my gross income, and I have no other insurance options remaining, what is going to happen? Is Medicaid available

    You get more health care insurance for your child.

    Nothing will happen. You will be in charge of the childs health care--if you dont have insurance then offer to pay for any medical issues the child may have.

    As long as it takes to get a court date there would be no reason for the ex to take you back to court.

    If you are both cordial and can speak just remind her about the insurance issue--what's she gonna do?

    The courts wont do anything UNLESS she does something. And she probably wont if you atleast offer to cover any expenses the child has during the switch.

    If the company doesnt offer it them you ook for an independant provider. or take her back to court and ask that she pays for the health care and up your child support.

    If your new job doesn't offer coverage, you'll need to pay it out of pocket for a few months. Do you really want your child to be without health care? Kids get hurt and sick alot. I have a feeling that if you let the health care lapse and he needs a doctor visit or gets hurt, you'll end up paying the whole amount. I can't imagine away that your ex would be expected to pay it, when you are the one who didn't live up to your court ordered obligation.

    Before you accept a job, you generally determine what the benefits package is. You need to find out what the benefit package will be for your job. If you are mandated to provide medical for your child and you accept a job that doesn't provide it after voluntarily leaving a job that did, you kind of look like you are trying to avoid paying your son's medical.

    Should your ex choose to take you to court about this, you will get screwed. Now that you have the responsibility of a child, you need to take these things into account when you consider the job. Pay the cobra for three months and make sure your job has medical. If it doesn't, you'll need to decide about paying cobra or finding another job. It sounds like this is more about money than your kid, which won't help either of you in the long run.

    providing medical coverage is part of your court ordered obligation to your child.

    this means you'll have to either pass on this new job & remain w/ your old job while you continue looking for a job that can help you make good on the court ordered medical coverage OR you're going to have to buy your own medical coverage for the child from an outside source, if your new employer isn't providing medical coverage for you.

    BTW: why did you take a job w/o knowing whether or not medical coverage is one of the bennies? That's part of your compensation package & you should know what your company is offering you before you tell them, "yes, I'll work for you."

    & since you know that you're going to have a gap where you won't be covered for a brief time, you're going to have to suck it up & pay the COBRA or look into getting some kind of temporary insurance (it is available) until your new policy goes into affect. or you'll have to pay out of pocket for any medical expenses the insurance would have picked up.

    The court has given you guidelines for the cost & what type of insurance you need to provide. There are polices out there that will meet your criteria, you just need to search them out if your new employer isn't going to have any.

    Go to ehealthinsurance.com and get a cheap Blue Cross Blue Shield policy. You are gettting seriously ripped off by your employers coverage. You can cover yourself and child for around $120 a month
