You are using the wrong term. You do not "expunge" a felony to a misdemeanor. You "reduce" a felony to a misdemeanor, pursuant to Penal Code section 17. This is possible for offenses which are punishable as either a felony or a misdemeanor, which includes Pen C 32. So long as no state prison sentence was imposed (even if it was imposed and suspended), a reduction to a misdemeanor remains possible. If it is reduced to a misdemeanor, under California law that reduction is "for all purposes," and does, indeed, restore your firearm rights.

As far as i do know the restoration of gun rights is unbiased out of your legal reduction and expungment. Wen you come to be a felon (even non-violent crimes) you lose gun rights automatically. Getting a discount and expungement doesn't necessarily restoration your gun rights automatically. So that you could ought to deal with that as an impartial topic. ==edit== 2004 -- legal conviction (that information goes to the Federal records and indicates on any background determine in each US jurisdiction) 2009 -- discount to a misdemeanor and later expungement (that is a State level deal, but the Federal govt doesn't know something about it yet; so any historical past determine nonetheless will show that you are not allowed to have weapons due to a criminal conviction.)

  • You cannot 'expunge a felony to a misdemeanor'. That is meaningless. In fact, you cannot expunge a felony at all, but even if you did, it would not remove the prohibition against owning a gun.
