I have a question about military husband and having to move with joint custody the father is not my husband?
my new husband will be moving to Tennessee after he gets back from deployment to Afghanistan I just found out we are having to move and I'm not sure if I'm allowed to leave the state of Texas with my son because my son's father and I have joint custody my son's father lives in New Mexico it's about 30 minutes away I wonder if my ex husband has already violated our agreement by moving out of state himselfbut I'm scared if it comes down to it my ex husband won't let me leave with my new husband I'm worried he has the power to keep me here anything you guys can do to help would be great my new husband is quite worried about the situation and I would like to put his mind at ease because he's in Afghanistan thank you

First thing is to talk with a family law attorney and file a petition to amend the custody order so you can join your husband. Do it now, so there won't be any delays when your husband comes home.

If you have joint custody and your husband has already moved out of state....read over your divorce papers really good and see what it says in there. If he is supposed to have your son for a certain number of days a month, then ya'll may just have to make arrangements for your son to travel...you said you have joint custody, but does your son primarily live with you? That makes a big difference if he does - if your son doesn't really live with your ex, but just visits on the weekends and holidays, that is not joint custody (like 6 months with you, 6 months with his dad) - that just means you have custody and he has visitation. You could take your divorce papers to an attorney and have him look them over and see what he says - most give free consultations. Check the wording, see what it really says and figure it out from there - Good luck!
