Will i be drug tested in this hearing?
So I have a charge of underage consumption of alcohol and I have my hearing tomorrow. i am only 16. it is an confidential informal hearing with a towns diversion program, not the county court. I am in ohio and just need to know if I will be tested, this is a first time offence. thanks. also, if i was tested and came out positive, what would happen
i am a successful kid and on the right track, i do not want an essay on how i should not do drugs. I am safe and would never ruin my life because of them. So please, do not give me an essay against them, i am smart, get good grades

I assume this hearing is about who supplied you with the alcohol.. as you mention it is an informal hearing of the town's *diversion* program. If by diversion you are referring to a drug court, pre-trial diversionary program (similar to DUI court, etc) -- then YES, it would be quite likely for you to be ordered to submit a drop that day.
I mention this below -- but you should , if you feel things are headed this way,.. make a motion (request) to retain counsel -- and thus your proceeding be put on hold and resumed at X weeks (however long you think it will take for you to find a lawyer) -- IE: 2-3 weeks.
You very well could be drug tested -- my intuition is you will NOT be given the nature of this hearing,.. however the judge can order it at any time.
If you were tested, and came out positive for illicit drugs they may elect to put you in a juvenile 'drug court' type of program (probatory) program for a period of months to 'get you off 'drugs' and 'alcohol'.
You wouldn't go to jail, (or in your case, juvenile hall).
You will be fine.. I suspect it will just be general questions regarding the incident. Though you may wish to retain a private attorney if you want to protect yourself to the fullest extent. At the hearing, if things seem to be leaning toward any criminal adjudication (rulings/pushing you into programs/self admissions etc.. ) You should then request that the hearing be postponed for (X weeks) so you can retain counsel. Which is your legal right.

Im sorry but I cant stick to your question. Why are you asking about drug testing if your offense was underage drinking? Its obvious you use drugs as well as alcohol. Please, please take the "diversion" as a learning lesson. Dont try to just get by. You are 16 years old. Who knows how long you have been drinking and drugging. If you happen to watch cops, you may notice people getting arrested and going to jail. The show doesnt say what happens those people. They go before a judge and they may get bailed out while awaiting a trial. If convicted, it stays on their record the rest of their lives. For instance, lets say you make it till your 18 without killing someone or yourself. You get pulled over one night after a party and arrested for dui. You go to jail, you get bailed out, maybe. You spend thousands of dollars on attorney fees and you are still found guilty. You do the time or pay a fine or worse, you get probation that you have to pay every month. Then lets say you are lucky enough to make it through college with great grades. Your hope of finding a great job is running high. You send your resumes to a bunch of companies only to find out that they wont hire you because of that dui you were convicted of back when you were only 18.
Thats the happy, smily version of what could happen.
What could happen is you get into an accident while under the influence and kill someone. Sounds bad right? Is there anything worse? Of course there is. Your family could be having to feed you, bath you and even wipe your butt, because you became a vegetable after an accident.
Is this an extreme idea? Nope, not at all. It happens more often then you may think.
Bottom line is this, stop using drugs and drinking and you may have a chance at a happy life.

If its diversion they will prob test u, if u come up dirty on first one I think u just need to make sure it doesn't happen after that. Although with u being under age u can't have alcohol in system anyway so u may get in trouble.

risk is that if its a house try it wont take place on the try after twenty days. Well, as a 16 year old you certainly have the brains to know not to use controlled or illegal substances, so I don't think you will have any problems if they test. I wouldn't worry, then.

Not at the hearing, but it is highly likely it will be part of the diversion program. They do not have people pee in cups in courtrooms.
