Is it necessary to obtain Probate of a will if someone has left you a small amount of Rs. 30,000 in his will?

The bank is asking to submit a Probate of the Will and a Succession Certificate for transferring the amount in the beneficiary's account from the deceased person's account. The cost of obtaining the Probate of the Will and the Succession certificate is likely to be more than Rs. 30,000?

    If it is a registered Will, the bank can take indemnity and affidavit with sureties to pass on the benefits referred to in the Will left in your favour. The bank can alternately convert the said amount into cumulative deposit in your favour say for certain years with a lien on the deposits till such time they are satisfied that there is no claim on the money nor any possible claim in future.

  • You already have the information. The bank requires the documentation. They cannot just hand over the money because you say it's yours, they need official documents.

    If you feel that the estate is worth less than the probate costs, you can simply walk away.
