Involved in car wreck. How's do insurance companies determine fault?
Yesterday I was making a left turn into a gas station, and a guy ran a red light and hit my car. The other driver denied it. I had several witnesses there who witnessed the accident and they said the other driver was at least guilty of speeding. When the policeman came he asked for my paper work and that was it. He didn't ask me how the accident happened, he didn't interview anyone who had seen it happened. He didn't write anyone a ticket. He didn't take any pictures or measurements at the crash scene.
Basically the police report is going to say that I'm at fault because I was making the left turn. Without any of the witness information or measurements how is my insurance company to determine that it wasn't my fault? I called my insurance today and they are so supposed to call back. I'm I supposed to get a lawyer?

If as you described, the other driver ran the red light then that driver would be at fault. However, it's going to difficult to prove. Based off the information you posted, your only option is to hire an auto accident lawyer and sue. Your best case is if their is a red light camera at the intersection, then the lawyers can show right that the other driver is at fault or at the very least partially at fault.

"And that is the way it is"!
When turning across on coming traffic it is imperative to make sure that the move can be made safely. This includes judging on coming traffic and not assuming that a traffic light will protect you.
The witness can say what ever they want- but they had no way of knowing the other vehicles speed and they are not considered an "Expert witness".
Now you can go ahead and hire a lawyer, protest the report (the investigating officer often determines fault) all you want. But in the end more then likely it will only be throwing good money after bad. Meaning the lawyer will be able to afford a new car and will have money to take his mistress out for dinner at your expense. Your insurance will still go up.
So fight it if you want, but IMHO- minimize the damages (accept what has happened) and move on!

I hate to inform you, yet as quickly as the police placed all of this mutually, you would be finding at achieveable criminal expenditures against the two you and your husband. You lied to the police & stated you have been driving (submitting a pretend police rfile), your insurance is lapsed (driving without necessary insurance), failure to alter addresses on your license & registration in the 30 days required by ability of regulation. If this blows up on your face like it very properly ought to, i desire the bus runs out by ability of your place, considering which you ought to be finding at wanting to memorize the well-known public bus schedules or taxi employer telephone numbers for extremely some time. via fact the police will press expenditures & the DMV would be asked to droop/revoke yours and your husbands licenses. And it is not considerable what state you're in, the effects can incorporate penal complex time. You stated you had a small baby- in case you and your husband the two finally end up in county penal complex for some days, weeks, months- you will lose your baby. You do understand that don't you? so which you had greater advantageous desire the cops investigating & the different man or woman's insurance employer workers are approximately as remarkable as a burned out easy bulb & no longer the sensible, properly experienced cops I artwork with.

The police should determine who was at fault and if it goes far enough eventually a jury will decide who is at fault for an accident

You were at fault. When making a left turn, you have to yield to all other traffic. Saying he was speeding is pointless, unless his speed was witnessed and estimated by a police officer. You turned in front of the guy.
