Unfair waitress wages?
My friend makes $3.25 and hour plus tips. But they don't get much sit ins its mainly call out orders andshe'd be lucky to make a few bucks in 5 hours of work. If they don't make enough tips to equal minimal wage, should the company pay reimbursed their pay? Should i contract the department of labor? (its part time but hard to find a job here)

A fair days work for a fair days pay. Yes your friend is entitled to earn a living. Name and shame the employer that's making more money for themselves by paying the workers less.
What a great human that employer is.

The $3.25/hour is the minimum wage if your state allows an employer to credit tips. If your friend is not making enough tips to meet the federal minimum wage of $7.25/hour, the employer should pay the difference between her current wage plus claimed tips and the federal minimum wage.

3.25 is probably paid to offset that fact. I never received more that 2.20, and that was with a raise-it was 2.15 before that.
