should i pay child support if I the father takes care and provide for my son?
Hey guys a little advice would be greatly appreciated. I have 3 yr. old son that i take care of and provide for. His mother barely sees the little one until recently. i pay for all his needs and now she wants to put me on child support. She's only 19 and is really irresponsible. She drinks and always around bad crowds and doesn't even have a stable household. I don't mind paying child support but i know her too well. I used to give her 300 a month even though i'm mostly with our son, and i all i see is pictures on facebook her clubbing every weekend with new items for herself. Oh and she doesn't even have a job. Long story short i just want to know if i can win in court with proof of everything.
All we have on custody is just verbal agreement. She never wanted custody and i never filed for custody because we agreed but since she sees her friends receiving money she now wants to become a mother. The crazy thing is she admitted to me she just wants the money but she is going to make it look like she is the victim because the court always rule in favor of the mother.

Technically, whoever has the most custody doesn't have to pay child support..which is you. It's not always the father that pays child support, it is the person who doesn't have custody. My former step-father had custody of his son and the mom had to pay child support. Even after my former step-brother moved in with his aunt, his mom still had to pay his dad child support. Either way, the mom of your son sounds like a terrible excuse for a parent and shouldn't be awarded custody at all. Talk to the court system and keep the child away from her. For all you know, she could be on drugs and she could end up neglecting the child.
-edit- Get ALL of the proof you can that she is an unfit mother and not worth having custody. Secretly record her when you two talk in person, save text messages from her, show the courts pictures off of her Facebook of her partying, etc.

You should file for custody if you are already taking care of the child. Then at the same time get child support from her. If she does not have a job she will have to get one or risk jail, just like men do.
Keep a log of how much time she has the child.
Who takes care of kid while you are at work? Get an estimate of how much that would cost in daycare fees.
Then watch out for the false allegations of abuse or molestation. That is usually the next step in a womans aresenal in a quest for custody and money.

Who has the child? As for providing for the child, anything provided outside a court order is considered a gift and not support.

If you are the main carer for your son and you can prove it she should pay you child support not the other way round
