Is this a valid reason to report T-Mobile to the FCC and BBB?

So, I'm stuck in a dispute between T-Mobile.

I have the HTC Sensation, and I've had many problems with it. I've had 3 replacements in less than a month within each other.

On March 26th, I contacted T-Mobile and they gave me the third sensation. On that same day, my account was noted saying that after the third replacement, I'm able to get a comparable phone model.

The third replacement I received won't keep the charger in the phone. I've called T-Mobile about it several times, and they state that "We see the notation on your account saying that you're able to get a comparable model for your phone, but there's no replacement compatible with the HTC Sensation," "We've done everything possible to help you in this situation," I called their tech support and I was told that the Samsung Galaxy s2 is the comparable phone model for my phone. I told customer care this and they still said that they see the notation but can't do anything...

T-Mobile keeps on telling me to use the upgrade on another line on the account, but that's my brother's account and he really needs a new phone. So I cannot use his upgrade. T-Mobile also is telling me to change my plan to one of their "Uncarrier" plans and upgrade, but I'm going to have a migration fee which is over $200 and the plan will make the bill cost go even higher. They're also telling me to keep on receiving refurbished HTC Sensations which all have the same problems over and over again.

Oh and here's the worst part. I was charged a $92.99 and $5.55 out of warranty fee. The one of the phones I received had dead pixels in the screen when I turned it on, and T-Mobile replaced it with no problem. The second phone would overheat and it also wouldn't hold the charger in it properly.

So I'm trying to report T-Mobile to the FCC and the BBB. Is what I just explained worth the time of complaining to those two corporations? I'm hoping that they'll let the three accounts leave with no termination fee or to give me a new cell phone.

I'm sorry that this is so long everyone, but can you answer it please? 10 points to the best answer. :)

Update:

I've only had the phone for a year. I purchased it on March 31st 2012 from a T-Mobile store. They sold it on their website last week for a limited time.

Anyway, why should I have to upgrade, and pay an early migration fee if I'm only a year and two months into the contract? T-Mobile has given comparable replacements for phones older than mine before like the Samsung Vibrant...

Update 2:

It makes no sense as to why I have to purchase a new phone and my contract isn't even finished yet. T-Mobile should honor their f*cking policy.... T-Mobile should honor what they noted on my account.

Do you work for T-Mobile? The time I purchased the phone, it was still considered new...

    Your phone is 2 years old... that's an eternity in the life of smartphones.

    There aren't any good quality refurbished units available for replacement. The phone is so out of date there is nothing "comparable".

    This is certainly not an issue for the FCC or BBB.

    You purchase a new phone or you buy yourself out of the contract.

    Add'l Info: your discounted or free phone that you got with your contract is not really associated with your contract. It's a bonus - like when you get a free hat for signing up for a magazine. The magazine does not replace the hat if it was lost or damaged before the subscription is up.

    - the warranty / insurance for the phone is based on the warranty / insurance on the phone. This is 100% separate from your cell contract.
