Can an employer discriminate against cigarette smokers?

Is it legal for employers to say they wont hire a cigarette smoker. I found a job I am a great fit for, but they wont hire a smoker. Oh well, their loss.

    even if it was they would come up with another reason and they do not have to hire you at all even if your the best person for that job hell they can even fire you for smoking and there is nothing you can do about it

    and u can try to sue over it but it wont work even if you can find a lawyer to take the case which won't happen unless you can get multiple people to stand with you

    No. It does drive insurance premiums up though. If the employee handbook and company policy does not say they will not hire people who smoke and you do it on breaks and lunch they should not discrimate. If they want non smokers and you really want the job...quit smoking...they will find another reason to not hire you....

    Federal law, and most state laws, do not forbid employers from discriminating against smokers.

    They can discriminate on Grounds of Health, as well as the amount of time you are absent fro your desk having a smoke.

    Yes they can. Case went to court multiple times and anti smoke has always won
