State Legal Residence Issue?
I want to make sure I have no problems with my taxes. I work in Italy about 160 days per year and I have a home in New Jersey and two homes in Florida. One of the homes in Florida is my legal address and I am registered to vote there and my cars are registered there etc.
I only spend about 40 days a year in Florida and 160 over seas and about 150-160 in New Jersey as my business requires me to be in the tri-state area for meetings etc.
I was told that if my legal address, cars and voter registration is in Florida and I do not spend more than 183 days in any other state, that I can claim Florida as my legal residence in the US because I am out of the country much of the year.
If the year is divided as listed above - 160 days out of US, 40 days in Florida and 165 days in NJ
Can can choose Florida as my legal residence state without any issues?
Thanks!

No, you absolutely cannot claim Florida as your primary legal residence. You do not live or reside in the state of Florida just because you own homes and cars there. Your home in Florida is not your predominant and principal home. You visit the state of Florida for a paltry amount of time each year. You are not a legal resident of the state. You cannot choose Florida as your legal residence state. You will be expected to pay taxes in Florida as well as in New Jersey. New Jersey is the only state you can claim as your legal residence.

Don't listen to what you were told. Look at state laws in Florida and New Jersey.

As you describe the situation you are required to list New Jersey as your legal residence and vote there.
