Can you transfer probation from Florida to North Carolina?
Does North Carolina accept Probation supervision transfer from Florida? .. My grandma is sick in North Carolina ... and I made a few mistakes over the years and now I want to move back up there to take care of her because my grandfather passed away and shes all alone now. Does anyone know if North Carolina would accept a transfer from Florida? ... Someone told me Tennessee doesn't accept people from florida .. but im worried because I have 5 years probation. Thanks and god bless.
Don't say ask my PO .. because I already did that and hes an a.hole so he beats around the bush and acts like he don't want to do it for me.... hes like ohhhh it will take 6 months to a year.... balhblahblah ..... and he don't know if his supervisor will let him ..... and then I went to a lawyer and he said he would go to the courthouse for me to ask if florida supervised people could be transferred to North Carolina because he knew that Tennessee doesnt allow people from florida to transfer to their state, and he would let me know ... well he hasn't called in 3 weeks so there must be some database or something online that someone could find on this subject. thx all

This is governed by an interstate compact (Commonly know as ICOTS)agreement that all 50 states participate in. There are not enough details for me to say whether you qualify. Most misdemeanors charges can not be transfered. All felonies can. However, first your PO has to approve the transfer. If he doesn't, you're out of luck. If he does, there may be a fee involved. In my state there is a 100 fee that you do not get back if denied.
If your PO will put in the transfer, it will then go on to his supervisor for a review. If his supervisor approves it will go on to the sending states ICOTS liaison who will look it over for procedural/ICOTS rules details. Then it will go to the recieving state's liaison who will do the same. Then on to the appropriate supervisor who will finally assign it to a PO in the receiving state to review and approve. They will do an investigation to verify information on where your living, who lives there, if its suitable living conditions, etc. This whole process can take 45 days from the date the receiving state gets it.
There are criteria for what is a mandatory transfer and what is descretionary for the receiving state. Yours sounds like a discretionaty transfer from the details provided. Which means the receiving state does not have to take your supervision.
Additionally, your lawyer can do very little for you as the courts of your state have no jurisdiction in the receiving state. The only possibility is if your in a state where your attorney could petition the courts to discharge your probation early.

question is will florida allow you to transfer probation to north carolina. north carolina is not going to initiate the request for you. If your PO refuses to start the process, make an appointment with his/her supervisor or the judge that sentenced you.

depends on the court and your p.o because they have to request the state you want to go to if they would take you and if they refuse to do so then you stay in the state you're in.
