how can a judge allow a criminal charge to be changed?

the martin/zimmerman case just came on the news that the judge will allow a new charge of manslaughter to be placed on zimmerman. how can the prosecution be allowed to add charges at the very end of a court case?

    In the Zimmerman case, manslaughter technically is not a new charge. It is classified as a lesser included charge that may be considered in murder cases. The judge has discretion to allow or disallow any lesser included charges.

    Trekker has it right. Manslaughter is a lesser-included charge to murder in the second degree, and either the state or the defendant is entitled to a jury instruction on lesser-included charges if the evidence presented supports them.
