Can my previous job hold my check?

I am suppose to be getting my last check from my previous job which is in colorado and they told me to give them my current address when I get it (currently living in Texas). So I called them today and the general manager said that he has to hold it due to me oweing him $40 that came out of HIS pocket and not the company's pocket. Is that legal to do? Would be great to get advice from someone who studys the law

    Any money you owe him personally has nothing to do with what the company owes you. I'd call his supervisor and tell him/her what is going on. You could actually sue the company to get that check-and in some states you can sue for extra because of his actions.
