Should I fight my Red light violation ticket?

I was on my way to Taco bell one crisp night in California, when I see the light as yellow. I slowdown to make my right turn, then half a second before my tire crosses the line, the line switches to red. I drive a pickup and if I was to stop, i would be inside the intersection, blocking the walkway for pedestrians, as well as cars turning left. Anyways, I was still in motion as the light turned red, and *Flash* i get a $480 dollar ticket.

You knew the light was about to turn red, and you decided to try to beat the light and lost. If you go to court you will not get a higher fine ($480 is the maximum), but you will certainly lose and could also lose the opportunity to go to traffic school. You might, however, suggest that the fine is too high. You are charged with violating Veh C 21453(a). I, and many others, believe that running a red light when making a right turn is a violation of Veh C 21453(b), with a much lower fine (about $260).

You can if you like wasting time. They have a picture of your truck in the intersection after the light turned red. Instead of slowing for the turn, you should have stopped.

You should have stopped on the Orange/yellow light

as that is why it is there,

to caution you that the light is going to change to red.

You can fight it if you want,

    BUT

I doubt that you will beat the ticket,

but you could also end up with court costs as well as the fine.

If you are willing to spend the time to go into Traffic Court, it could be well worth it.

A lot depends on your record. Judge might be lenient if you have a clean record.

More importantly, there is a reasonable probability that the officer won't show up, in which case, "case dismissed"!

You can try but still have to pay the ticket.
