Complaint for Partition.?
I have offered fair market value for my sisters part in our Mom and Dads home. Can she not sell to me because she does not like me. She wants to force an auction and would rather loose money than see me have it. SAD. I live in Tennessee.

She doesn't have to take your offer. You could sue for partition, but the court would rule that she sell, which she is doing.
I would see if she would use a 3rd party to settle the matter.

Either owner/partner can force a sale of the property by filing a Partition lawsuit. A judge will require an appraisial of the property and order the sale. This remedy is expensive and can take 6 months to a year or more.

Yes, she has the same rights you do and if you can not agree on what to do with the property you may have to have the courts decide.

Assuming that she has full claim, and is not the Jurisdiction Having Authority, you have no case.
