If a county jail is full and your scheduled to serve 48 hours for dui will they book and release you?
My husband has a first offense dui in Tehama county (CA) and is scheduled to serve 48 hours. The jail is over booked. Will they jail " book and release" upon arrival and if so, is that considered time served or will he have to return to serve at another time?

They'll just transfer someone, most likely.

They will release other inmates earlier to make room for your hubby to serve his time. That is common. A jail sentence means a jail sentence.

We had guys report at another jail for their sentence.
Or make them sleep on a mattress on the floor. But no one ever got early release's. You do the crime you

Jails have plastic portable beds called "boats." He'll just be placed somewhere in the cell block in one of these.
