Apartment lease criminal background check, misdemeanor 22 years ago in a different state? Will we be denied?

My boyfriend and I are about to apply to a luxury apartment complex in Dublin, California. Besides credit check I believe they will also do a criminal background check because the application asks "have you ever been convicted of a misdemeanor or felony". I am clear, but my boyfriend had a misdemeanor 22 years ago in a different state (non violent crime, for drug possession) and was convicted.

I heard from a friend that they probably only check the last 10 years and it is unlikely they will pull records from another state... what do you guys think? Any chance we will denied the apartment for his misdemeanor from 22 years ago from another state?? he has had NO other criminal charges ever. Maybe they will overlook it? I am a nurse with a high paying job and good credit score ~ that should be enough to get the apartment right?? Again we are in California.

    Sorry Yari, you're incorrect.

    In the state of California, you are only legally allowed to ask about criminal background for the past 7 years. That's all the state allows. The only exception is for registered sex offenders, who must register for life.

    So if the question comes up as "EVER been convicted", it's a generic form that's illegal in California. Feel free to answer 'no', because it's been more than 7 years and won't come up in the database.

    Credit and back ground checks are based on social security numbers and information would be found by the credit reporting agency as well as those that provide background checks from any state, not just California.

    If that was the case all a person would need to do would move from Arizona to California and no criminal records would be found.

    In some instances you might look at your rental application as most would ask if you have ever been arrested or convicted in the last 7 years.

    If your rental application does not limit criminal activity to seven years then make sure you answer the question truthfully and indicate under what circumstance this happened and also the fact this happened 22 years ago with no additional criminal activity.

    Misdemeanors normally would have a lifetime of 5-10 years,after which they would normally be sealed and no longer a part of any background check. You might would want to check the laws of the state in which this criminal activity took place and ask for the records to be sealed.

    If you would not want to waste your time and money for a credit and background check, tell the property manager up front about the record of your boyfriend and let the landlord indicate if this would be a problem of not.

    Determining if a landlord or property manager would accept a person with a criminal record would normally be at the discretion of the landlord. Some would accept you with a good letter explaining the reason for the criminal action.

    Others take a hardline on any criminal activity and would not under any circumstance allow you to rent one of their rental units.

    You indicated you had a high paying job with a high credit score. You did not indicate what your boyfriend did, his earnings nor is credit score. In some instances his job required some type of background check, and would indicate if the criminal record of 22 years was a problem at the time he was hired.

    Its a sensible way to start. The site allows you to do a no cost scan simply to find out if any sort of data is in existence. A smaller analysis is done without cost. To get a detailed report its a modest payment.

    You may not realize how many good reasons there are to try and find out more about the people around you. After all, whether you're talking about new friends, employees, doctors, caretakers for elderly family members, or even significant others, you, as a citizen, have a right to know whether the people you surround yourself with are who they say they are. This goes double in any situation that involves your children, which not only includes teachers and babysitters, but also scout masters, little league coaches and others. Bottom line, if you want to find out more about someone, you should perform a background check.

    The absolutely free background check sites generally provide the most basic of information, such as name, age and address. To get further information, money will have to be paid. The free searches do not provide much more than what can be found through the phone book or personal knowledge. It's impossible to get a free background check.

    Stay away from shady background check sites, most likely you won't get any information after you make the payment. Not to mention you won't get a report and you won't get an answer if you try to call for a refund. Stick with a reputable background check site like http://backgrounddetectives.info/Inteligator-7.htm... that has been around since 1999. If I remember right it's $19 for a full report.

    While that conviction will stay on the record, one that old and in a different state has a good chance of going unnoticed. I'm not sure where your friend got their information about 10 years, because when we order them we do not specify to only go back so far, but I'm not certain that the company that provides these to us doesn't have some sort of limit for the services we purchase from them.

    Anyway, I'm always an advocate of honesty and disclosure, but if he has been exemplary since then I'm also a big advocate of second changes if the time/fine has been paid. In this case, something that old could easily be attributed to his bad memory and minor level of the infraction.

    If it does surface they may ignore it, or ask about it, or turn you down with no questions. If he was pretty young at that time (I'm guessing he was adult since a juvenile conviction would only show up to law enforcement searches), he could say "Oh, gosh gee, I had completely forgotten about that. At the time they told me it was the equivalent of a traffic ticket so all these years I haven't even mentioned it thinking it was just that."

    We can't know for sure, but I think this is so old and minor it will not affect you.
