HELP PLEASE I AM IN DEEP TROUBLE WITH SSI.

I was involved in car accident in 2008 that changed my life. Teenage kid who was in cell phone went through red light and straight to me. I started to get ill, I had back problems, but my biggest problem was that I could not lift my right leg. I started to drag my leg, after while the left leg. Going to doctors was a horror for me. Finally, after being misdiagnosed few times, I got to see my neuro, who did brain MRI and said I have relapsing remitting MS (Multiple Sclerosis). I was only in my late 30. I started my treatments, I got a lawyers, one for Disability one for the accident. Both cases were settled in May 2013. Disability gave me hard time. I filed 2010, for three years I was broke, in welfare, it was horrible, since I never had experienced such life style. My wife didn’t work; she went back to school so in case I get worst she takes over the responsibilities. I got my accident settlement because my Neuro testified saying that my MS symptoms became it worst from the accident, or showed up after the accident in the other word, if I was not involved in the accident my symptoms would not show up maybe another 10 years. Finally I got approved for disability SSI. They should have give me lump sum of 20 thousand doll, but they decided to give me 2600 doll every 6 months plus 627 doll monthly. I told my lawyer I got settled from my accident, he told me that is my body injury money, the disability people cannot do anything. I paid lots of debts because I was broke since the time of the accident till May 2013; I have left some money in my join account with my wife, which probably the way things going my wife trying so hard to find job with no successes, I just got a letter from SSI telling me to bring all three of my accounts and see someone there because they want to know where my money came from. I guess they found out, but remember, my lawyer said not to say anything because that is my body injury money. I have to survive with that little money left, 627 doll a month would not even feed us, what about my rent utilities, they want us to be homeless? Please anyone tell me, should I take the money out or keep it in my account. Are they going to stop my SSI? This is how people hand up living in streets. Why are they doing this? I can barely walk; my wife does everything for me and in the house, around the house. My appointment is Dec 13. Please help this is scaring me to death. THANK YOU.

    Were you able to get a sex change operation in the last year, along with that eight week trip to Europe you had with your husband?

    We can read the questions you've asked. A year ago you and your husband needed a cat sitter. Now we find out your wife went back to college. Half a year ago you were trying to get off a drug your doctor put you on for arthritis and bulging disk. Now your leg drags. AND, you stopped trusting your doctor then because he "lied to you," but now you find out your lawyer lied to you too.

    Sorry. I can't feel sorry for someone with a wife, a husband, a cat, drug problems, an eight week trip to Europe (and yet apparently the leg makes it so you can't work), all within one years time. I don't think it's the lawyer that's lying.

    You might want to get better at making up your story as you go along though.

  • Your lawyer gave you bad advice or you didn't understand it completely. You did not have to report any money you got from your settlement if you spent it within 30 days. The minute you put it into a bank account to save it became a resource and accountable to Social Security.

    You will have to pay back what you were not entitled to. What you did is considered double dipping and you are entitled to only one dip.

    It doesn't mean diddly squat what your lawyer says - he isn't the one who committed fraud and received money they weren't entitled to and if you think that the social security employees are so stupid as to believe that he gave you that advice anyway then you are stupid indeed. And even if he did - like I said - he wasn't the one who committed fraud. YOU are responsible for knowing what to report. YOU are responsible for seeing to it that YOU reported your excess income and resources (it was income the month you received it; a resource after that month). And it is YOU who will be responsible for paying it back.

    SSI which stands for supplemental security income is the federal welfare program. Welfare. That means that you and your wife are allowed up to $3000 in resources. $3000 or more makes you ineligible for WELFARE benefits.

    You were advised of your reporting responsibilities when you initially filed your claim. You were advised of them again when you received your award letter. You knew you were not entitled to those benefits and yet you received them and used the money anyway. And now it's time to pay the piper.

    Somehow they will get that money back. If you and your wife are due any federal income tax refunds from now until doomsday those refunds will go to social security until the overpayment has been repaid. If you ever become entitled to any type of benefit from social security in the future monies will be withheld until the overpayment has been repaid.

    You got caught - give us whatever sob story you want - I don't feel sorry for you. You should have thought about the possible consequences when you were spending monies you weren't entitled to.

    I might be mistaken, but I believe for SSI you can only have X amount of assets in order to qualfy. If your settlement put you above that amount then you are no longer elegiable.

    If it's just you and your wife, then $627 is definately enough to pay for food. I don't even spend anywhere close to that amount a month for myself.
