He can be prosecuted if he was on drugs or alcohol,but i believe all the tests came back clean.
I think it is rude to guess he was out all night, he could have had a sick child at home or any one of a hundred valid reasons.
Rather that seek a scape goat, how can sick or sleepy train drivers be prevented from allowing this happening again.
