can i take amazon to small claims court?

So back in September my mother had an outstanding balance on her Amazon store card of about $480. I took my own money and paid for it, but i couldn't find her card so we paid for it over the phone through amazon where they offered me a $60 discount if i paid it in full then which of course i did. Turns out they have no idea where my money is, the account is still racking up debt i believe its up to $700ish now. I have called over and over again and its either we still cant find anything, or speak the bank (GE Capital) and then they tell me to call amazon. I sent in 3 faxes so far of my bank statement showing i paid for it, but none of they times they say they got it or couldn't find it. I really could use that money back or to clear the account though.

and how reasonable is this?

If i win give me my money back ($420), and close the account.

I have been trying my best but its always another persons department and they will send it but it may take up to two weeks to investigate of which i hear nothing from them.

    Get off the phone and fax machine. Put it in writing and mail it certified, return receipt.

    You may want to get your bank involved in trying to track down the payment -- get some kind of papertrail as to where the payment went.

    You made your first mistake making a payment by phone .... and not having the actual account number. Your payment was probably posted to someone with a similar name's account. It's further complicated because you have extra parties involved ... you paid thru Amazon, your mother's card is thru GE, you used your bank account.

    You will get no where suing Amazon. They will just pass the buck to GE ... who will pass it back. You have absolutely no papertrail and won't be able to prove anything.

    you seem to be getting the "run-around" from a large organization where one hand has no idea what the other is doing. Even though the net amount you claim is relatively small, you should engage the services of legal counsel and the attorney will sue for your claim amount and damages as well as his fees. Either that, or ask the attorney to take the case "on contingency" where he only gets paid a percentage if he wins.

    In America, you can take anybody to small claims court, but if you lose, it may cost you money in legal fees.
