Am I going to lose this case on EBay?

This was my auction.

The guy waited 22 days after the auction closed to contact me about the item. I tried to compromise with him; I needed him to either return the (If he agreed I was going to send him money for the shipping) or a picture of the item confirming what he said. He refused to do either of those. He said he threw it out because it was damaged (he said some battery acid spilled on the games). The games were delivered to his parents house and his mom opened it, he was out of state when the package arrived. I can’t tell if he’s lying or not that’s why I needed a return or a picture, at first he left a few things out about the condition of the item and then he gave me inaccurate information. I tried to be civilized with him, but he just kept insulting me. I can’t refund him his money without either a return or a picture of the item as he described it.

I’m going to lose this case, right? EBay is going to side with the customer, even without any proof, right? Do I have any chance?

    Not necessarily. You didn't specify what case you're talking about. If the guy opened a SNAD case, just politely tell him that you'll give him a full refund upon return. If he doesn't send a package to you with Delivery Confirmation within the time limit of the case, eBay should close the case in your favor. Of course, there's no guarantee. Hopefully he won't ship you an empty box.

    You do have a right to demand a return before issuing a refund. How long would any store stay in business if the customers could just walk up and say, "I spilled battery acid on the item I bought and threw it away, I want a refund"?

    What did he tell Ebay? What did you tell them? Did you upload a photo of the condition when you sent it? Ebay wont refund him if he does not ship the item back. He is probably faking. You can appeal Ebay's decision if they do refund him and take it from you.
