What can I do about wages not being paid and employer adjusting hours?

My husband's employer has yet to pay him for after hours calls that was done 3 months ago. The amount they were to pay him was $385 for this call. Also when he is at work, he does not get a lunch because they always have something come in for him to do for tire work. His boss goes in and adjusts his hours to compensate the company for his hour lunch even tho he did not get his lunch. Is there any recourse for the company for not paying him the hours they owe him? If so, what is the best way to go about this because his boss refuses to fix the problem. It is also not just my husband that they do the lunches on. It has happened to several others as well.

Update:

First off this is FAR from a min wage worker. LOL He earns a good $8 if not more over min wage where we live. Its a tire shop and he actually does service calls for big trucks.

And there's not much to improve there. He brought it up to his boss along with some other issues with sexual comments made to him about another employee...and I just got the call he was let go. So I don't think there is much we can do now.

  • If they have not paid him the full amount that he is owed, your best recourse is your state Department of labor. There is usually a division called something like 'Wages and Hours", and their job is to settle such disputes.

    You should be wary that such a report will NOT improe relations with his boss, and the next time there is a layoff for any reason, your husband could be on the list.

    Ah, Ha, you've brought up a real problem for the low wage earner who thinks raising the minimum wage is the answer to their prayers {WRONG}. The businesses that hire min. wage people, fast food,etc. are going to get scre#ed..... The employers will cut hours to 30 a week so they don't have to pay insurance or vacation or bonus money and will also cut the number of employees. Wake up to the real world.

    Call your State Department of Labor in give your statement may have to open claim. call law office which deal with such matters.Keep records you will have to be able to back up your claim
