My iPod is spazzing and I don't know what to do?

So I got the new iPod for Christmas, for about a week or so now, it has be acting up. It will stop songs when I never touched the pause button (and play when I never hit the play button), fast forward though songs, and Sirius/voice memo will appear at random. I can barely get thorough one song. I don't know what is wrong. I do have to say, the other night it fell out of my pocket when I got out of the car, did not realize, so I was out in the cold for a night (I have a case on it) but again, it has been happening before I left it out in the cold. Any ideas? (Besides brining it to apple)

    I advice pressing and holding the power button and home button together till the iPhone reboots. If that doesn't fix the problem, you should do an itunes restore like the other guy suggested

    I advise a restore through iTunes.
