Is it legal for the school to donate my son's phone?

My foster son's phone was confiscated at school. He deserved to have it confiscated because he refused to turn it in upon entering the school. Every other student abides by the rules except him.The policy which he was aware of, is that the phone is taken away and never returned.I really have no idea if the phone is really donated to a charity or if the principal keeps it for himself. I could understand if the phone was kept until the end of the school year but it is legal for the school to donate his phone?

    No, it's not legal. Theft is theft regardless of where it happens. It's only a parent who can take an item off a child never to return it. Oh, and the school has to return confiscated property to the student's parent when asked to do so (by said parent). I'd suggest you go to school on Monday morning and insist they give you the phone...and refuse to leave until they do. They have absolutely no justification for not returning the phone to you, and you should make them do so asap.

    The phone was never returned. They claimed that I agreed to the rule by signing the student handbook. I still think it was wrong but I got over it. The phone was inexpensive. My kid has now a more and I would be upset if it was confiscated even though it would be his fault for not following the rules. They also changed the rule about phones, because of the fuss I made last year.

    This year my kid has a more expensive phone he has a more expensive phone. This year, because I made such a fuss last year, they changed the policy to keep the phone until the end of the year.

    No the school has no right over the phone whats so ever. They only have a right to take it away for some time but they do not under any circumstances can donate the phone, break it, lose it, or get rid of it. They have no rights to it. They probebly wont give his phone until you go there to retrieve it as they want you to know why they did it.also the schools are suppose to hold it maximum 1week, or the end of the week. some might hold it longer but usually that's the limit.

    No, it's not legal. Usually the school can only hold students' cell phone until the end of the school day, and parents need to come and pick it up. If they refuse to return the cell phone to your kids even when you request then you should sue them.

    Nothing in the rules about entering a school and handing over your phone is legal at all. I suggest you expose the school for their law breaking. If its a religious school, medieval on those nuns.

    This is against the law for them to give it away heck its not even ok to take it away for small time want to know why? if you bought it it is yours if he bought it it is his both ways it is theft from you or your son
