Car was damaged at work?

I work in construction and we have some temp help from a temp agency. We were taking out some carts and one of the temps lost control of a cart and hit my car. Now he isn't taking blame if course and wondering what I should do if anything. Will the temp agency cover it? I know the guy will tell his boss that it wasn't his fault so I don't know what to do.

    The agency is responsible for any accidental damage their workers may cause, by rights they should have public liability insurance which would cover this, if not they have to pay out of their own pockets and they might be breaking the law too. If they or their insurance company wants their money back after paying you then it's up to them to harass their worker for it.

    It's not your job to mediate between them and their worker.

    Obviously if it were deliberate damage then that would be a different matter, the worker himself would be directly responsible for that and could also be arrested.
