HOTEL RENT IS PAID TILL 9/22/2014 owner can't pay for utilities and we were served with 30 day eviction notice?

What rights do I have since I have paid rent already. Must he refund or find me a place to stay at his expense.

    You have a right to a refund. But if he can't pay utilities and you are being evicted, I bet a bankruptcy is not very far behind. And at that point, you become a name on a piece of paper, and might get pennies on the dollar if you are very lucky. The rest of the debt (or all if it) will be discharged in the bankruptcy, and you lose it. You should be able to claim it on your taxes, though (if in US - if not, consult the laws where you live), but you are not getting it from him if he does declare bankruptcy.

    Best thing is to consult a lawyer now to see what you can do.

    you neglect to say where this is happening or why the court is ordering this eviction.

    if you're in America, then yes, you're 'entitled' to a refund of prepaid rent. BUT don't hold your breath on getting it. as others point out, if the owners can't pay the utilities, he's a few pages of paper away from bankrupt and your chances of seeing your money are slim and none.

    You should be entitled to a refund. But you may have to go to court to try to get it. I hope you have proof of everything you paid -- and you have the rental period in writing. That said, if he can't afford utilities, he probably won't have the money to pay you back. But you can get a judgment and try to get it if and when he gets on his feet.

    He should refund your money, for the time you are not there. If won't, sue him in Small Claims.

    You have a legitimate claim against the hotel owner, but it is PRACTICALLY worthless. If they can't pay the utility bill, it isn't a question of IF they file bankruptcy, but WHEN. Even if you were at the TOP of the list to get paid, and you are actually near the bottom, you wouldn't see ANY funds before the end of the year.
