Can i legally attack my neighbor?
He threw rocks at my dogs because they were barking at him. My dogs were inside my property and were far from escaping. I reasoned with the man and warned him not to do it again. But, he never got the message. I am planning on hitting him with my baton after recording the incident so that i would have proof and i will then break his fingers. Is that self defense? Or is it a bad idea?
Cops never take me seriously with this matter.
What would you do?

1. Train your dogs to shut up. 2. Bring them inside when they start to bark. 3. Call the Humane Society and report him for animal cruelty. However, you have to take some responsibility. It is irresponsible and probably against your city ordinance to allow your dogs to bark longer than 10 minutes. You don't have Chihuahuas by chance, do you?

You can only use as much force as is required to stop the attack AND you must have no other alternative (like taking your dogs inside and calling the police). You would be arrested if you did what you describe.

NOT self defense. Aggravated battery - because you planned it and came online sharing your intent to commit battery). Perhaps attempted murder.

Very bad idea, Get it on tape and try to get him charged for animal cruelty and possibly vandalism if anything is broken. And depending on your state if you have any laws that say you can defend your self or your property.

This is illegal. This is aggravated assault and is a class C felony punishable by 3-6 years. You will be setting out to assault him. He has not attacked you, and you would be going out to attack him. You may attempt to have a suit against him for the dog incident, if your dogs were hurt.

Terrible idea. Call the cops instead. If you hit him you will go to jail and then he will probably kill your animals while you are locked up.

When he's not home, break all the windows to his house, scratch his car, make his life a living hell. Just don't get caught. ;-)
